Terms of Service

Last updated

These terms govern your use of ChatSpark. By connecting your Instagram account or using the demo, you agree to them. If you don't agree, please don't use the app.

1. What ChatSpark is

ChatSpark shows you your Instagram direct messages and uses AI to suggest replies in a tone you choose, so you can practise keeping conversations going. Suggestions are ideas, not instructions. You decide what to send.

2. Your account and eligibility

  • You must be old enough to use Instagram in your country and at least 13 years old.
  • Connecting requires an Instagram Professional (Business or Creator) account, because of how Instagram's messaging API works.
  • You must follow Instagram's Terms of Use and the Meta Platform Terms while using ChatSpark.

3. Using it responsibly

You agree not to use ChatSpark to:

  • harass, threaten, deceive, pressure, or manipulate anyone, or keep messaging someone who has said no or stopped replying;
  • send spam, bulk or automated messages, or impersonate another person;
  • send sexual content to anyone who hasn't clearly welcomed it, or anything involving minors;
  • break the law or violate anyone's rights;
  • try to bypass Instagram's limits, probe or attack the service, or access other people's accounts.

The AI is told to respect boundaries, but it can still get things wrong. You are responsible for everything you choose to send from your account.

4. Messages and Instagram's rules

Instagram only allows replies within a limited window after the other person's last message, and may restrict or suspend accounts that break its rules. ChatSpark is not responsible for limits or actions taken by Instagram or Meta.

5. AI suggestions

Replies are generated by third-party AI models and may be inaccurate, awkward, or unsuitable for your situation. They are not professional, relationship, or mental-health advice. Review each suggestion before using it.

6. Your content and privacy

You keep ownership of your messages. You give ChatSpark permission to process the conversations you open, and the text you ask the AI to respond to, only to provide the service. How we handle data is described in our Privacy Policy.

7. Availability and changes

ChatSpark is provided "as is" and may change, break, or be withdrawn at any time. We may suspend access if these terms are broken or if Meta requires it.

8. Disclaimer and liability

To the fullest extent the law allows, we make no warranties about ChatSpark and are not liable for indirect or consequential losses, lost data, lost relationships or opportunities, or account actions taken by Instagram, arising from your use of the app. Nothing here limits rights you have that cannot be limited by law.

9. Ending your use

You can stop at any time: log out, remove ChatSpark under Instagram → Settings → Apps and websites, or use Delete my data.

10. Changes to these terms

We may update these terms. Continuing to use ChatSpark after a change means you accept the new version.
